Removal of an arbitrator for justifiable doubts as to their impartiality: IBA guidelines on conflicts of interest in international arbitration (2014)

 

The English Courts have recently shown that they will take a robust approach to an arbitrator’s conflicts of interest, removing a sole arbitrator. In doing so, the Courts consulted and were assisted by the recently published IBA Guidelines on Conflicts of Interest in International Arbitration (2014) (“the IBA Guidelines").
